VIRAC, Catanduanes, Nov. 05, (PIA) - Commission on Elections (COMELEC) Catanduanes provincial office has reminded all candidates in the recently concluded barangay polls to file their sworn Statement of Contributions and Expenditures (SOCE).
According to COMELEC provincial election supervisor Atty. Maria Aurea C. Bo-Bonao, all winning and losing candidates must file their SOCE within 30 days after the election.
She said that in the case of the recent election, all candidates are required to file their SOCE before the Election Officer where they filed their Certificate of Candidacy on or before November 27, 2013.
Atty. Bo-Bonao added that pursuant to Section 14 of Republic Act 7166, winning candidates who will fail to comply with the above requirement will not be allowed to assume office and fines of up to P60,000.00 as well as perpetual disqualification from holding an elective post.
Per COMELEC Resolution No. 9476, candidates in the barangay election, being a non-partisan political practice, are only allowed to spend P5.00 per voter during the campaign period.
The following must be indicated in the SOCE as stated in Section 3, Rule 8 of COMELEC Resolution No. 9476:
a.) The amount of contribution, the date of receipt, and the full name, profession, business, taxpayer identification number (TIN) and exact home and business address of the person or entity from whom the contribution was received;
b)The amount of every expenditure, the date thereof, the full name and exact address of the person or entity to whom payment was made, and the purpose of the expenditure; A Summary Report of Lawful Expenditure categorized according to the list specified above shall be submitted by the candidate or party treasurer within thirty (30) days after the day of the election;
c.)Any unpaid obligation, its nature and amount, the full name and the exact home and business address of the person or entity to whom said obligation is owing;
e.)If the candidate or treasurer of the party has received no contribution, made no expenditure, or has no pending obligation, the statement shall reflect such fact and; e.) such other information that the Commission may require.
